Privacy policy

The website available at the following address: https: //marih.fr (hereinafter referred to as the ” website “) is published by the MaRIH rare immuno-hematological diseases health network, managed and financed by the French Ministry of Health, and housed at Hôpital Saint-Louis, Pavillon maladies rares, 1, avenue Claude Vellefaux – 75010 PARIS (hereinafter “MaRIH MaRIH “). The purpose of this privacy policy is to inform persons browsing the Site (hereinafter referred to as “Users”) of the confidentiality of the information they provide to us. Users “or “ User “) of MARIH’s practices concerning the conditions of collection, use and sharing of information that Users may provide, as well as their rights. The Site complies with French and European standards relating to the protection of privacy and personal data, and in particular with law n°78-17 known as “Informatique et Libertés”. Informatique et Libertés “of January 6, 1978 on data processing, data files and individual liberties, as amended by Law 2004-801 of August 6, 2004, and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, known as the ” RGPD ” on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

MaRIH is responsible for processing personal data.

 

  1. Type of data collected

 

Data is collected on the Site as part of its use and is that which enables MARIH to identify Users directly or indirectly.

 

This may include the following categories of data concerning its Users:

      • personal data, i.e. first and last name, profession, e-mail address, landline and/or mobile telephone number;
      • connection data such as IP address and browsing data such as cookies.

Users who communicate the personal data of a third party must confirm that they have the consent of this third party to the use of the latter’s personal data by the Site.

 

  1. Purpose of the personal data collected

 

The personal data collected on the Site are used only for :

      • enable the User to register for MaRIH training courses;
      • to keep the User informed of the latest developments in its business;
      • send targeted content to the User, corresponding to his/her needs;
      • communicate with the User.

 

In addition, MARIH may use the data to meet its legal and/or regulatory obligations, if any. MARIH reserves the right to publish, disclose and use aggregated information (information about Users or specific groups or categories of Users combined in such a way that an individual User can no longer be identified or referred to).

 

  1. Time of collection

 

The data collected by MaRIH is freely communicated by Users, in particular when the User sends a request to MaRIH via the contact form provided for this purpose and/or by e-mail and/or on its social networks referred to in the legal notices, as well as by registering for the training courses offered on the Site. In any event, the personal data collected :

      • will be obtained and processed fairly and lawfully;
      • will be recorded for specific and legitimate purposes;
      • will be used in accordance with these purposes;
      • are adequate, relevant and not excessive in relation to these purposes; and
      • will take precautions to ensure the security and confidentiality of data to prevent it from being damaged, modified, destroyed or communicated to unauthorized third parties.

 

  1. Consent

 

The present confidentiality policy is systematically brought to the attention of Users when they visit the Site. By checking the box:“I acknowledge that I have read and understood the privacy policy and I accept it”, the User consents to his/her personal data being stored and processed by MaRIH and/or any of its partners.

In addition, where required by law and/or in certain circumstances, the User’s consent will be obtained or an opt-out facility will be provided prior to any transmission of data.

 

  1. Recipients of personal data

 

The recipient of the personal data collected on the Site is MaRIH. Personal data will not be communicated to third parties for commercial purposes. However, other recipients may have access to personal data. These include, where applicable, MaRIH’s resource providers in charge of the Site (administration, legal, etc.) and its external service providers (technical service providers, access providers, communications agencies, etc.). In the event of a change of control of MaRIH or any other form of transfer of assets, the data collected by MaRIH may be transferred to third parties. Nevertheless, MaRIH undertakes to guarantee the confidentiality of the personal data collected and to inform Users before such data is transferred or subjected to new confidentiality rules. In the event that this is required by law, the User’s consent will be obtained or a possibility of refusal will be provided before any data is transferred.

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, known as the ” RGPD ” on the protection of individuals with regard to the processing of personal data and on the free movement of such data and Law No. 78-17 known as the ” Informatique et Libertés ” of January 6, 1978, amended by Law 2004-801 of August 6, 2004 relating to information technology, files and freedoms, the User has:

      • the right to modify personal data;
      • the right to rectify personal data;

In the event of exercising one of these rights, the User must provide MaRIH with the information required for identification: surname, first name, e-mail address, telephone number and, if applicable, postal address.

 

In addition, in accordance with the regulations in force, the request must be signed, accompanied by a photocopy of a signed identity document, be clear and specify in detail the right they wish to exercise, as well as the address to which they wish to receive a reply if they wish to exercise one of the rights listed above.

 

MaRIH undertakes to respond within a maximum of three (3) months following receipt of the User’s complete request.

 

Due to the complexity of the request and/or the number of requests, this period may be extended to six (6) months on condition that MaRIH informs the User of the reasons for the postponement within one (1) month of receipt of the request.

  1. Data retention period

 

8.1. Conservation des données suite à la collecte

 

The personal data collected from Users is not retained beyond the time necessary to achieve the purposes described in this privacy policy, except for data that MaRIH may need to retain as evidence, for legal or administrative purposes or in accordance with current legislation.

 

8.2. Conservation des données anonymisées au-delà de la relation entre MaRIH et l’Utilisateur

 

MARIH retains Users’ personal data for the time strictly necessary to achieve the purposes described in this privacy policy.

 

Browsing data will be kept for a maximum of six (6) months in accordance with CNIL recommendations.

 

After this period, they will be anonymized and kept exclusively for statistical purposes and will not be used for any other purpose whatsoever.

MARIH will not be responsible for any information that is sent to or collected by these third parties.

 

This Privacy Policy does not govern third-party sites or third-party content accessed by the Site User. MaRIH has no control over hypertext links.

 

Consequently, MaRIH does not give any guarantee concerning the personal data protection practices of the indexed websites and cannot under any circumstances be held liable in the event of a dispute arising between a website indexed on the Site and one of the Users, in particular for any loss or damage suffered, as the operators of the indexed websites are solely responsible for their personal data protection practices.

 

  1. Cookies

 

A cookie is a text file that may be stored in a dedicated space on the hard disk of the User’s computer when he/she visits an online service via his/her browser.

 

In practice, cookies are small text files that are placed on the User’s computer by the websites the User visits. They are used to operate the websites and improve their usability.

MARIH processes User data only within the European Union and does not transfer such data outside this area.

 

However, in the case of international transfers outside the European Union, a distinction must be made between :

MaRIH may use pixel tags (also known as ” web beacons ” or “clear GIFs “) and other similar technologies to collect information about the use of the Site, in accordance with the RGPD

 

Pixel tags are invisible graphic files integrated into the Site that make it possible to track Users’ activities and collect information on the devices and browsers used to access the Site.

 

The information collected by pixel tags may include personal data, such as IP address, browser type, pages visited, access times, and other information about interaction with the Site. In compliance with the RGPD. MaRIH processes such personal data on the basis of users’ consent and its legitimate interest in improving and personalizing the user experience and analyzing trends.

 

If the User has the right to withdraw his consent at any time, to request access to his personal data, to rectify them, to delete them, to limit their processing, to object to their processing, and to request their portability. To exercise these rights, please contact MaRIH by e-mail.

 

By using the Site, the User consents to the use of pixel tags and other tracking technologies in accordance with this Privacy Policy and the GDPR.

 

If the User does not want MaRIH to use pixel tags or other tracking technologies, the User can adjust their browser settings to block these technologies or unsubscribe from certain third-party tracking services.

MaRIH undertakes to implement appropriate and reasonably necessary technical and organizational measures with regard to the regulations applicable to the protection of personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, in order to guarantee a level of security appropriate to the risks incurred for the rights and freedoms of natural persons in connection with the processing referred to in this privacy policy.

 

When personal data is transferred to third parties for processing, MaRIH ensures that these third parties implement all appropriate technical and organizational measures to ensure the protection of personal data in accordance with applicable laws.

 

These measures are defined taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of the processing, as well as the risks identified.

 

Depending on needs, risks, costs and the purpose of processing, these measures may include data pseudonymization and encryption.

 

This protection can be ensured by the mention of ” https ” in the browser’s URL address, and by the representation of a closed padlock at the bottom of the screen.

 

Finally, in the event of a violation of rights concerning personal data likely to generate a high risk for the rights and freedoms of the User, MaRIH undertakes to inform the User of this violation within a maximum period of seventy-two (72) hours.

MaRIH reserves the right to modify and update this privacy policy at any time, in particular in order to take into account any legal and/or jurisprudential developments and to meet the requirements of the regulations applicable to the protection of personal data.

 

MaRIH will inform Users of any significant changes or updates to it by e-mail.

 

The prevailing version is that which is accessible online on the day the Site is consulted.
